McClelland's Complaint Rebuked

From the front page of this morning's ER comes Jeremy Lydic's report that the Ohio Elections Commission (OEC) has returned former Wellsville politician John McClelland's complaint alleging that Mayor Joe Surace fraudfully used campaign funds. The OEC reportedly return the complaint to have it corrected and notarized. Apparently Mr. McClelland did not correctly cross reference exactly just what section of the Ohio Revised Code he was using as the basis of his complaint. To save money he didn't bother to consult any legal authority before firing off his letter to the OEC. To save a buck he just goes ahead and tries to destroy a man. Maybe he should have consulted with The Wiz to have his complaint researched before sending it off.

Even more telling of McClelland's thought process is what he was quoted as saying to Mr. Lydic. Verbatim I quote from the ER article: "McClelland said he understands why the OEC sent the complaint back, but said he believes the complaint itself should hold precedence over the process. The (OEC) is there to protect the best interests of the public. McClelland said If someone has a legitimate complaint, the OEC should look at that and not if all the i's are dotted and the t's are crossed". Apparently McClelland believes the OEC process should be disregarded just for him.

You're wrong John. In something as serious as this it is very important that all the i's are dotted and the t's crossed. You should have made yourself extremely knowledgeable in what the law says about this matter and at least correctly used the right sections of the ORC. You dropped the ball on that and not having your signature notarized. Were you saving another buck there? If you knew what your were talking about you would have known that little part about verifying who sent the complaint.

You were correct in saying the OEC is there to protect the interest of the public. That's why you got the complaint sent back to you. The OEC has to be fair and impartial and follow the law to the t. They can't follow up on a complaint on supposition. That's exactly what the basis of your complaint is - supposition. You are assuming your facts are accurate and now you are belittling the OEC for following the rules. Maybe a little thought should be employed before you go off on a temper tantrum.

My best advice is to drop the whole thing. Save yourself some money. You seem adept at that.
I seriously doubt if you have any hard proof. It's seems to be your word against the Mayor. Let it rest.

Ole nib: Since my sign on was mentioned in your blog, I thought I would add my two cents! First, I would suggest when you write, try using your spell check. I can understand leaving your commenters misuse words at times but it leaves a lot to the imagination when the administrator use inappropriate words.. I am talking about your use of the word “rebuked”. Totally inappropriate with what Lydic wrote!

You assume that John is trying to destroy a man! That is a big crock of BS! You evidently just do not get it (or I guess that is what you would prefer). Reading your writing one can only assume that if not anyone who you agree with should be questioned. Again BS!

If you knew what you were talking about you would know that the OEC is there to ensure that anything submitted to commission has to be accurately described. The reason was not that an invalid complaint was lodged but that the commission would not have to do research on every “i and t“. The research is what the employees of the OEC are paid for. If these office employees state that John’s complaint is valid or otherwise, the commission will act on that referral. If you had read the Ohio Code, you would know that it is best not to do everything just right because you are looking for the staff’s suggestions/remarks. Exactly what John did! Maybe, just maybe John knows more than you would like to think he knows!!!

With your comment, “Apparently McClelland believes the OEC process should be disregarded just for him“ you just show your disdain not only for John but for the right of any citizen. Maybe you should just apologize to John and permit the process to work. When you made the crazy statement “the basis of your complaint is - supposition”. Again it is oblivious you don’t know what you are talking about! If what you say were true, they would not have notified John to re-submit. Think about it!!!!

Your “best advice is to drop the whole thing” could be used with a dollar to buy a cup of coffee, if anyone would be interested. An lastly, this has nothing to do with John verses the mayor…..it has everything to do with a person running for elected office and following the Law. Nothing more and nothing less!

Ole Nib is basically telling people they don't have a right to question. Tell me something Nib, what makes you an authority on this topic? If you read the paper carefully, it doesn't say the letter was not notarized, it said it was not properly notarized. Some imply that John filed a complaint because the mayor gaveled him down......hogwash. It was already in the works but maybe if the mayor had taken time and answered his questions (which he doesn't seem very good at) he could have explained it all to John and maybe convince John he was wrong or maybe the mayor could of had his wife explain it, if she were there. If Surace did nothing wrong then they have nothing to worry about. If they can prove John wrong then so be it. If John is wrong he will apologize to the mayor. But if John is right......well, that's a different story.

All this was already in the works as a last-minute election ploy that nobody would pick up on because there wasn't any proof. Yeah, they bought stamps. But there's no proof that that mailing used those stamps. Even if the proof is shown, he'll just get a fine, not thrown out of office. Dave Lloyd needs to run for council, win that and then go for mayor. And quit surrounding himself with every discontented person in town.

Is it me or does anyone else see a similarity in the writing style of The Wiz and Muhammad Jones?

Hey Wiz - I would think an intellectual such as you would understand the use of the word "rebuked" which is defined in one way as "to check or repress". The complaint was returned to be checked for the correct ORC section and was consequently repressed by the OEC as it was originally submitted. So, are you saying the OEC was wrong to return the complaint?

Ole nib: Judging from your response, it is apparent you consumed too much turkey yesterday. You are aware that overeating blocks blood flow to the brain and hinders one’s ability to process and select appropriate words when attempting to show intellect in his or her writing. Again, I highly recommend you stick with your picture taking and leave the written word to those more able. I am, of course, referring to “rebuked.” Had you reviewed either Websters or the World English Dictionary you would understand your error. However, I understand your intent, as I stated before which is to degrade John’s actions and give your like-minded readers the appearance of your righteousness.

I don’t see my writing in the same league as Muhammads’. Just wish I was!

can't wait once again you show your ignorance by not investigating before you type. Do some research. Then ask questions. Check official links not just this one. Surace can have the office at village hall it's going to be a hot one. We'll just have to sit back and see how hot his seat will get before he jumps and runs. He has a lot to answer to and the answers need to start now. Once again he is waiting for the taxpayer to pay attorney cost to get the answers he doesn't want us to hear. Then what next more attorneys so the next problems he has caused will be answered? But I guess from what i read on this blog the amato law office is going to be giving him a lot of advice. Maybe after they think about it they will be intelligent enough to tell him to find someone else to fix all the problems he has caused. Time will tell and the people will be waiting......BUT FOR HOW LONG? Will the village residents just sit back this time? The sad story continues...

Don't worry about it man, worry about your own shit. Worry about a fake Mayor who won an election on deception. Worry about the problems to come from the lack of leadership you voted for. Worry about the roof leak and other leaks inside village hall that has caused many problems. Worry about racketeering, corruption and other alleged activities. Worry about how the Village will pay for law suits filed, and ones about to be filed. Worry about blackmail and setting people up. And don't worry about the cost of attorneys to help mcclellan, they are standing in line to help free. And if Surace didn't use the cards as part of his campaign let him prove it. Mcclellan is 100% right on this one. Keep up the good work Johnny Boy.

i said it once and i will say it again does anyone know the difference between a town and a village???????? in a town the mayor has complete authority in a village the COUNCIL does..... so if any lawsuits are to be filed against the mayor they might want to check and make sure none of their favorite council people are involved hate to see you cut off your nose to spite your face
